risk-assessment algorithm may flag a criminal defendant as a flight risk
based on what similarly positioned defendants have done. And while automating
government decisions may seem efficient, the assumptions
that AI systems make are often wrong and can be harmful to the public. "
Authored by Fergusson, the report takes an in-depth look at the national
use of AI procurement systems, the variety of AI tools deployed by state
governments and the major private companies behind them, and the
risks and issues involved.
Fergusson says that EPIC is recommending four actions for state agencies
to take when using AI: (1) implement robust AI testing and auditing,
(2) require protective contract language so agencies can better monitor
AI systems operated by contractors, (3) implement greater public transparency
around AI decision making, and (4) stop AI use when an agency
cannot mitigate its risks.
EPIC has also brought its concerns to the federal level. On January 5,
2024, EPIC filed a complaint with the Federal Trade Commission against
Thomson Reuters for its allegedly faulty AI fraud-detection system in
at least five jurisdictions, including Washington, D.C., that locked out
hundreds of thousands of legitimate claimants from accessing public
benefits.
