marine genetic resources benefits and for collective rights. The final text
also realized the aspiration for effective BBNJ inclusion of technology
transfer and capacity building.
Daniel Kachelriess, an independent expert on oceans and wildlife law
and policy who participated in the BBNJ negotiations as part of the NGO
High Seas Alliance, offers insight into the digital sequence information
aspect of the BBNJ Treaty. He says that the negotiators at the BBNJ talks
kept the contemporaneous CBD digital sequence information work in
mind but wanted to set up modes for sharing DSI specific to the BBNJ
agreement.
" In the BBNJ text now, digital sequence information is included in almost
all provisions around collection of marine genetic resources, " Kachelriess
says.
" It was a great step forward, " Kachelriess adds, but running it in parallel
with the CBD will require attention. " I think nobody wants to end up in
a system where you have different requirements depending on where
your digital sequence information is coming from because that would
increase regulatory burden. "
HOPES FOR THE FUTURE
There is no shortage of ideas to better manage genetic resources and
benefits. For Dutfield, instead of hoping for the rare discovery of substances
that could lead to a blockbuster drug, efforts should focus on
encouraging equitable business arrangements for international commerce.
He
also feels that upscaling and regulating easily made biotrade products,
like shea butter from West Africa or Moroccan argan oil, would offer
promising returns for local peoples.
More dialogue in all forums is certainly the goal. Kachelriess and others
believe that the BBNJ Treaty has a good early record in this regard.
" Coming from a western country, it is important to listen to the voices of
southern countries, developing countries, when it comes to equity and
hear how they assess it, " Kachelriess says. When the BBNJ negotiations
concluded, the developing nation parties - the African group, in particular
- conveyed satisfaction about the treaty's marine genetic resources
provisions.
" And I think that is quite a good litmus test: Did we manage to advance
equity in treaty making? " he says.
