Moss turned the recordings - a cornerstone of
the government's case - into a hallmark of the
defense. As she stated to the jury: " So after a
year at this point, of trying to create a crime,
spending tens of thousands of your taxpayer
dollars flying around the country, wining and
dining all these different people, of stooping
low enough to go to Marcus Gillum, Andrew's
younger brother . . . after hours and hours and
hours of recordings, the FBI was left with nothing.
Still, they are trying to hit that target. " 9
" We always talk about embracing 'bad' facts, "
Moss explains in our conversation. " Of course,
we wished there had been no investigation
that resulted in recordings from these undercover
agents, but they provided context and
informed the jury of what was really happening. "
This
context amplified the theme of the client
being targeted. It worked. The jury acquitted
on one count and hung on the others, ultimately
prompting the government to dismiss
the remaining charges.
