Disciplinary Actions Taken by the
District of Columbia Court of Appeals
Original Matters
In re John P. Mahoney. Bar No. 442839. June
13, 2024. The D.C. Court of Appeals accepted
the Office of Disciplinary Counsel's and Mahoney's
joint petition for negotiated discipline
and suspended Mahoney for 60 days,
with 30 days stayed in favor of one year of
probation with conditions for violations of
Rules 1.4(a), 1.16(d), 5.1(b), and 5.1(c)(2). Mahoney
voluntarily acknowledged that in six
client matters he failed to take reasonable
steps to ensure that two subordinate attorneys
complied with their ethical duties to clients
and did not take reasonable remedial
action to avoid or mitigate the consequences
of the subordinates' conduct, of which he
knew or reasonably should have known. In
four of the six matters, Mahoney personally
failed to respond to reasonable requests for
information from the clients (and one of
those matters involved a proceeding pending
before a federal tribunal sitting in Maryland).
And in three of the six matters, Mahoney
personally failed to protect the clients'
interests as the representation was ending.
In re Brian Jeffrey Rosenberg. Bar No.
1045584. June 21, 2024. The D.C. Court of Appeals
granted Rosenberg's petition for reinstatement.
In
re Rachelle Young. Bar No. 997809. June 13,
2024. The D.C. Court of Appeals accepted the
Office of Disciplinary Counsel's and Young's
joint petition for negotiated discipline and
suspended Young for 30 days, fully stayed in
favor of one year of probation with conditions
for violations of Rules 1.3(a), 1.4(a), and
1.4(b). Young voluntarily acknowledged that
in three client matters she failed to represent
the client diligently and zealously, failed to
keep the client informed of the status of the
matter and comply with reasonable requests
for information, and failed to explain the matter
to the client to the extent reasonably necessary
to permit the client to make informed
decisions regarding the representation. In
two of the three matters, she failed to protect
the client's interests as the representation
was ending, and the third matter involved
misconduct that occurred in connection with
a proceeding before a federal tribunal sitting
in Maryland.
Reciprocal Matters
In re Joshua N. DeBold. Bar No. 989159. June
20, 2024. In a reciprocal matter from Virginia,
the D.C. Court of Appeals imposed reciprocal
discipline and disbarred DeBold. The Virginia
State Bar Disciplinary Board revoked DeBold's
law license following his guilty plea to domestic
assault and battery as well as attempted
assault on a law enforcement officer.
In re Robert E. Glenn IV. Bar No. 413279. June
20, 2024. In a reciprocal matter from Virginia,
the D.C. Court of Appeals imposed reciprocal
discipline and disbarred Glenn with reinstatement
conditioned upon his reinstatement in
Virginia. Glenn consented to revocation in
Virginia in lieu of contesting a pending disciplinary
complaint. He admitted to improperly
obtaining $35,000 from his former law firm
and using those funds for personal expenses.
In re Nelson Gonzalez. Bar No. 465407. July
25, 2024. In a consolidated reciprocal matter
from New Jersey, the D.C. Court of Appeals
imposed reciprocal discipline and suspended
Gonzalez from the practice of law in the District
of Columbia for six months, nunc pro
tunc to April 11, 2023, in the first matter and
for three months, nunc pro tunc to April 21,
2024, in the second matter. Gonzalez's reinstatement
to the practice of law is conditioned
upon both a showing of fitness and
proof of reinstatement in New Jersey. In the
first matter, the Supreme Court of New Jersey
adopted a Disciplinary Review Board decision
finding that Gonzalez violated New Jersey
Rules of Professional Conduct 1.1(a) (gross neglect),
1.3 (lack of diligence), 1.4(b) (failure to
communicate), 1.5(b) (lack of written fee
agreement), 3.2 (failure to expedite litigation),
5.3 (failure to supervise nonlawyer employees),
7.1(a) (misleading communication about
the lawyer or the lawyer's services), 7.5(a) (letterhead
violation), and 8.1(b) (failure to cooperate
with disciplinary authorities). In the second
matter, the Supreme Court of New
Jersey adopted a Disciplinary Review Board
decision and found that Gonzalez violated
New Jersey Rules 3.3(a)(5) (failure to disclose
to the tribunal a material fact knowing that
the omission is reasonably certain to mislead
the tribunal), 8.1(b) (failure to cooperate with
disciplinary authorities), and 8.4(c) (engaging
in conduct involving dishonesty, fraud, deceit,
or misrepresentation).
In re Jason M. Krumbein. Bar No. 475531. June
20, 2024. In a reciprocal matter from Virginia,
the D.C. Court of Appeals imposed reciprocal
discipline and suspended Krumbein for 90
days. Krumbein consented to a 90-day suspension
in Virginia and stipulated that he neglected
a consumer debt matter, resulting in
a default judgment against his clients, and
thereafter failed to notify his clients of the
default judgment or their right to appeal.
Interim Suspensions Issued
by the D.C. Court of Appeals
In re Kellee G. Baker. Bar No. 992003. June 28,
2024. Baker was suspended on an interim
basis based upon an order of the Supreme
Court of Maryland suspending her license to
practice law indefinitely with the right to apply
for reinstatement after one year.
In re Robert H. Biden. Bar No. 973866. June
25, 2024. Biden was suspended on an interim
basis based upon his conviction of a serious
crime in the United States District Court for
the District of Delaware.
In re Rudolph W. Giuliani. Bar No. 237255. July
23, 2024. Giuliani was suspended on an interim
basis pursuant to D.C. Bar R. XI, § 9(g),
pending final action on the Board on Professional
Responsibility's May 31, 2024, recommendation
of disbarment.
In re Kristopher E. Twomey. Bar No. 979338.
July 17, 2024. Twomey was suspended on an
interim basis pursuant to D.C. Bar R. XI, § 9(g),
pending final action on the Board on Professional
Responsibility's May 31, 2024, recommendation
of a two-year suspension.
