Women's Law Center (2021).
Meanwhile, gender-affirming bathroom and
locker room access has led to incidents of
sexual assaults of women and girls by biological
men identifying as women and by biological
men taking advantage of equal access
facilities. An April 2017 report titled " Bathroom
Incidents " by the Family Research Council cites
numerous news reports of transgender women
or men dressing as women who were charged
with voyeurism in bathrooms and changing
rooms. There are commonsense and incredibly
compelling reasons for policies that protect
women's sports and gender-specific access.
Additionally, the author fails to report a peerreviewed
2021 study from the National Library
of Medicine's National Center for Biotechnology
Information that found that a vast majority of
boys with gender identity disorder come out of
this identity post-puberty and eventually come
to align with their biological sex. Of the 139 boys
assessed in the Gender Identity Service, Child,
Youth, and Family Program at the Centre for
Addiction and Mental Health in Toronto, Ontario,
in 1989, " 17 (12.2%) were classified as persisters
[those who continue to have gender dysphoria]
and the remaining 122 (87.8%) were classified as
desisters " in a follow-up study in 2002.
In his opinion piece " Religious Liberty Is Not
Just for the Chosen Few, " Frank Lindh argues
that the Founding Fathers were not particularly
religious. But it is widely reported that nearly all
of the Founding Fathers were religious and
imbedded religious principles into the founding
documents, whether we like it or not.
According to Britannica:
Whatever their beliefs, the Founders came
from similar religious backgrounds. Most
were Protestants. The largest number were
raised in the three largest Christian traditions
of colonial America - Anglicanism (as in the
cases of John Jay, George Washington, and
Edward Rutledge), Presbyterianism (as in the
cases of Richard Stockton and the Rev. John
Witherspoon), and Congregationalism (as in
the cases of John Adams and Samuel Adams)
. . . . Three founders - Charles Carroll and
Daniel Carroll of Maryland and Thomas
Fitzsimmons of Pennsylvania - were of
Roman Catholic heritage.
Mr. Lindh advocates for public preference of
secularism but fails to report that religion and
secularism are on equal footing, and that any
animus against religion or favoring secularism
over religious expression is a patent violation of
the First Amendment. See Kennedy v. Bremerton
School Dist., 597 U.S. ___ (2022), fn. 1.
I encourage the editorial board to consider
publishing articles from a neutral perspective
that consider both sides of the argument, at
the very least. To see story after story representing
the views of the most progressive
faction of the Bar is disenfranchising to the
majority of members who align closer to the
middle.
