Wakschlag's and Whitlatch's organizations were among the parties
that joined the American Civil Liberties Union in its amicus brief to the
Superior Court of Los Angeles County in support of Spears's expressed
desire to select her own attorney for her conservatorship proceedings.
The groups also asked that supported decision-making be used in the
process, illustrating Wakschlag's point regarding the availability of less
restrictive options even within the context of broader conservatorships.
After the June hearing, Spears's court-appointed counsel stepped down
and was replaced by one of her choosing. On September 29 Spears's
father was suspended as conservator of her estate. A November hearing
has been set to consider her request to end her conservatorship.
In July, the Freedom and Right to Emancipate From Exploitation Act,
alternately called the FREE Act or the Free Britney Act, was introduced in
the House of Representatives. If passed by Congress, it would facilitate
the removal of a conservator at the ward's request without having to
prove misconduct.
In the District, the Legal Counsel for the Elderly has been lobbying for
the passage of the Uniform Power of Attorney Act. " The District's powers
of attorney haven't been updated in more than 20 years, " says Parker of
the D.C. Long-Term Care Ombudsman.
The proposed act " strengthens the protections for individuals who place
their trust in somebody else, " according to Yourougou, who recently
testified before the D.C. Council in support of the act. " The act makes it
clear what the duties of a power of attorney actually are statutorily, while
the previous version largely fails to. It clearly says that it's a fiduciary relationship,
and the statutory form would also encourage people to think
carefully before creating a power of attorney. "
As of March 2021, at least 40 states and the District of Columbia have
introduced pieces of legislation referring to supported decision-making,
but legislation is just the first step to ensuring that the rights and liberties
of individuals with disabilities and the elderly are respected. Advocates
say true safeguards will require that people know and understand the
laws and make deliberate efforts to tailor the least restrictive support
systems possible.
