E-Verify is an online database that allows businesses to
determine if an individual is legally authorized to work
in the United States using data from the U.S. Department
of Homeland Security. But E-Verify is not mandatory
in the District of Columbia, and, according to a 2013
study by the National Restaurant Association and
ImmigrationWorks USA, only about 23 percent of all
restaurant operators routinely use the system to verify
employment authorization of their new hires.
Washington, D.C., immigration lawyer S. Sarah Shah
believes it is unlikely that a higher minimum wage would
lead to the hiring of more undocumented workers.
"That may have been the case a few years ago, but not
anymore. Especially in the District, Homeland Security
has set examples of certain businesses to make the
hiring of unauthorized workers more and more unlikely,"
she says.

Edelman says this is an issue for law enforcement to
address. "It absolutely is not a justification for not raising
the minimum wage," he says.

culturally acclimated as new immigrants," she says.
For authorized immigrant workers, the concern is an
increased risk of termination as employers struggle to
meet the new minimum wage requirements.
Orr, however, says increasing the minimum wage would
have little effect on immigrant workers. "Any impact
would be the same as it would be for regular workers,"
Orr says.

Shah also foresees minimal impact, but recognizes that
minimum wage-level jobs may become more
competitive. "The increased minimum wage will attract
more diverse applicants. Workers who wouldn't work for
a smaller minimum wage may now be willing to work
for a larger amount, which may push out immigrant
