dvocates for better access to
justice are finding a powerful
new strategy for opening the
doors to the courthouse -
or at least the virtual ones -
to make the promise of equal justice
a reality for all.
Online courts, a relatively new development in the last five years, are
taking off in Canada, the United Kingdom, the United States, and a
handful of other countries, with people beginning to reinvent their justice
systems using the same technologies that allow them to get a mortgage,
pay taxes, or place a bet on a video game online.
Add artificial intelligence, blockchain, and the advent of big data and
decision algorithms to Moore's Law of exponential growth in processing
power, and the trajectory of online courts looks both inevitable and
unpredictable. As the brilliant science fiction writer William Gibson has
said, "The future has arrived - it's just not evenly distributed yet."
Indeed, futurist and UK legal scholar Richard Susskind predicts that by
2030 the development of online courts worldwide will bring radical
change to the tradition-bound business of court administration and the
risk-averse legal profession. It's already happening, argues Susskind, who
has emerged as one of the world's leading thinkers on virtual courts.
"I don't think that any credible court administrator or policymaker or
judge can think that in 2030 the court systems will be as they are today,"
Susskind says in an interview with Washington Lawyer.
Since September 2016, the United Kingdom has invested 1.2 billion
pounds in the world's most sweeping effort to modernize a court system
anywhere through innovation and technology. The program assumes
a wholesale shift to accessing justice digitally. "It's very clear that we have
a growing movement here, not simply to automate processes we've used
in the past, but also to provide an entirely new platform for public
state-based resolution," says Susskind, president of the UK Society for
Computers and Law and a technology adviser to the lord chief justice
of England and Wales.
