A NOT-SO-BIAS-FREE
HIRING PROCESS?

I read with interest the article on
the potential for AI to remove or
User Data, Privacy & Big Tech
reduce implicit bias in hiring, particularly regarding the use of "cognitive games" in the hiring process
("Coding Out Implicit Bias With
AI," October 2019). Something
new, I thought, until I came across
CODING OUT
IMPLICIT BIAS
Hardware Hacking Dangers
the following: "The only way for
WITH AI
any law firm to know for sure
[whether the games work] is to
hire half of the associates based
on the games and [the other] half
on the old criteria and process.
Six months out the firm can look and see who is performing better, and
then they'll know whether the games work." But isn't the firm's "look
and see" subject to its own implicit bias?

NO ONE WRITES LIKE JAKE
Perhaps the most inspired decision
of your editorial tenures was to start
reprinting old columns of Jake Stein
as the "Last Word." The most recent,
"E=Procrastination= MC2" (October
2019), reminded me of my own pure
joy of reading Jake's columns every
month since I joined the D.C. Bar
in 1978. A couple of my old senior
partners at my original firm were
poker buddies with Jake, and I met
this sweet, brilliant lawyer a few
times. As a failed creative writing
major in college (ergo, on to law school), I have always been in
complete awe of his turn of a phrase and his wry humor. Seeing these
old essays again after a decade or more, [it's] as if they are brand new,
as I remember so little as I'm myself now an elder. Thanks for bringing
Jake back on paper. We must appreciate this unique character.
